The short version

Garcia, already in a court fight with Sophia Filfil over Sofi Lakes (cause 2026-70357), filed a new and separate civil lawsuit against her in Harris County on Oct 29, 2026. The clerk assigned it to the 234th Judicial District Court and issued citation on Oct 30, the paperwork that lets Filfil be formally served.

The claim is sexual assault and battery. Garcia asks a jury to decide, and seeks monetary relief over $1,000,000, plus exemplary damages.

What the petition alleges

According to the petition, Filfil controlled the real estate and marketing projects Garcia worked on, and that Garcia’s role, his compensation and the business interests she promised him “all depended on her.”

The petition alleges that Filfil “repeatedly brought sexual talk” into messages that were otherwise about business. It cites late-night iMessages where she told Garcia she was “horny” and wrote that she “would love to hold you and sleep with you” (Exhibits A-1, A-2, A-3, A-7). It points to “What u doing single sexy guy” (A-5) and, at the end of a message about an HOA document, “And you look super sexy” (A-12).

It also alleges that she “tied sex and money together,” quoting “Make money,” “Since we can’t have sex,” and “Man with mind of money is sexier then naked man in the bed” (A-4). In the middle of business talk, the petition says, she wrote “But you are my bf” (A-9) and asked “Not my boyfriend?” (A-8).

The core allegation: on one occasion in Baytown, the petition says, Filfil gave Garcia alcohol from a bottle she kept under her sink, he became drunk, and while he was drunk she performed oral sex on him. The petition alleges Garcia did not want the contact and went along only because he believed Filfil would take away his role, his compensation and his promised business interests if he didn’t. In its words: “Garcia’s submission was the product of that economic pressure, not consent.”

The petition says Filfil later cut off all business dealings with him, and that he has suffered severe mental anguish, humiliation and emotional distress.

What the Lawsuit Claims

This is a civil tort claim for money damages. The petition argues the contact was without consent because, it says, it was obtained through economic coercion and while Garcia was intoxicated. It relies on Texas’s five-year filing window for civil claims of this kind (Tex. Civ. Prac. & Rem. Code § 16.0045(b)(1)) and asks for exemplary damages without the usual cap (§ 41.008(c)(5)). Whether any of that holds up is for the court and, if it gets there, a jury.

What happens next

With citation issued, the next step is serving Filfil. Once she is served, Texas rules give her a deadline to file an answer. This site will post her response and every new filing as the docket moves. Stay tuned.

How it fits

This is the third case in the saga, and it stands on its own. The others: 622 Sofi Lakes, LP et al. v. Garcia (2026-70357) in the 515th District Court, where Garcia has counterclaims and third-party claims, and Garcia v. Filfil et al. (26DCV0903) in Chambers County, where the court has signed transfer and abatement orders. Catch up in the news feed.
